Why would you pursue a guardianship?

Ontario courts will not simply grant a guardianship without good reason. You will need to show the following as they pertain to your loved one:

·         Can no longer discern the repercussions of decisions around health care, property, finances or personal care

·         In danger of losing property

·         May suffer harm due to poor health decisions

·         Easily manipulated into giving property and money to unscrupulous people

·         Vulnerable to elder abuse through isolation or the restriction of mobility by another family member, a caretaker or someone else

Now that you believe your vulnerable family member needs some help making decisions and taking care of him or herself, you will need to take the next step, which is applying for a guardianship.
