Guardianship Application

Our clients sometimes come to us to see if there is anything they can do for parents or other friends or family members who are suffering from mental incapacity and are no longer able to take care of themselves.

A person who no longer has the ability to understand the consequences of decisions about property, finances, health or personal care, but has not made arrangements to appoint an Attorney for Property or an Attorney for Personal Care, may need a guardian to make decisions about their finances, health or living arrangements.

Protecting Vulnerable Persons Through Guardianship

At Hagel Lawfirm, we know that mentally incapable people are vulnerable in many different ways. They may lose their property or endanger their health through bad decisions. They may be easily manipulated by unscrupulous people into giving away their property or making medical and financial decisions against their best interests. In extreme cases, they may even be vulnerable to elder abuse, as caretakers and other parties restrict their mobility, isolate them from loved ones or even physically harm them.

Our lawyer can help you protect your vulnerable loved ones by putting in an application for guardianship. We will answer all of your questions about guardianship, including:

  • What types of situations require guardianship?
  • How is mental capacity assessed?
  • What is a Capacity Assessment?
  • Who are registered Capacity Assessors?
  • Who can be a guardian?
  • What are the responsibilities of a guardian?
  • What is the process involved in obtaining guardianship?
  • What if your loved one has an Attorney for Property and Personal Care, but you are concerned about how the Attorney is performing?

With our experience working with families affected by mental health issues, we can help you decide how to take care of your loved ones and protect them when they are no longer able to protect themselves.
